  14. LICENSING AND DISTRIBUTION TERMS:

  17. The enclosed Quick Restart Test Drive Version Software is provided
  18. subject to the terms and conditions of the Software License Agreeement
  19. below.

  21. This TEST DRIVE version software can be freely copied and distributed
  22. by anyone by any medium through BBS, CD-Samplers or any other means
  23. without specific written consent from PowerPro Software, Inc. The
  24. only requirement is that all the accompanying files that were included
  25. in the ZIPPED Package of the Quick Restart Test Drive setup as obtained
  26. originally from PowerPro Software on its World Web Site at 
  27. http://www.power-pro.com or other authorized means be included, 
  28. including this notice of licensing terms of the Quick Restart Test-Drive
  29. Offer and the Program offering be specifically called 
  30. "Quick Restart - Test Drive". No portions of the package as supplied
  31. originally may be modified, added to or removed.

  33. Any other use of this program contrary to the terms of this License 
  34. Agreement is a violation of PowerPro's Intellectual Property Rights
  35. and can result in severe penalties. 
  36.  
  37. This free license to copy and distribute this "Quick Restart - Test Drive"
  38. software, precludes any other such free rights on copying any other 
  39. version or conversions or portions of PowerPro's other software products
  40. or other commercial versions of Quick Restart Software offerings. Your 
  41. rights as conferred to you by this Agreement are strictly limited to what
  42. is being offered herewith as "Quick Restart Test Drive" for the limited
  43. purpose of copying/distributing the program materials AS IS in a manner 
  44. that suits your interests and serves other PC user's needs.

  47. SOFTWARE LICENSE AGREEMENT:

  50. This is a legal Agreement between you (End User) and PowerPro Software, Inc.,
  51. (hereafter referred PowerPro). By copying or installing or using this
  52. Quick Restart Test Drive Software Package (hereafter referred as SOFTWARE) 
  53. you are agreeing to be bound by the terms of this Agreement.

  55. Grant of License: PowerPro grants you the rights to use the Quick Restart
  56. Test Drive Software free of any charges. You may not rent or lease or
  57. sell the SOFTWARE and/or accompanying materials in any form to any person
  58. except for distributing it for FREE or for the cost of the diskette
  59. medium in which it is transferred to the recipient. You may not modify,
  60. translate, reverse engineer, decompile or disassemble the Quick Restart
  61. Test Drive Software Programs. This Agreement is effective the day you
  62. install or copy the package on to your computer.

  64. Copyright and Trademarks: The SOFTWARE is owned by PowerPro Software, Inc.,
  65. and is protected by United State Copyright laws as well as other Intellectual
  66. Property laws and rights and corresponding international treaties. 
  67. Quick Restart is a trademark of PowerPro Software, Inc., and any other
  68. usage of the "Quick Restart" name without this acknowledgement is against
  69. the terms of this Agreement. The license provided under this Agreement
  70. is a limited one and in no way shall be construed to provide you an 
  71. express or implied license to any of PowerPro's Intellectual Property
  72. Rights other than as expressly set forth above and in no way confers you
  73. or anyone else any right, title or interest to the PowerPro Intellectual
  74. Property Rights in the SOFTWARE or the documentations.

  76. Governing Law: This Agreement shall be governed by and construed in 
  77. accordance with the laws of the State of California. This SOFTWARE is
  78. subject to the export control laws of the United States.

  80. LIMITED WARRANTY AND DISCLAIMER: THE PROGRAM IS PROVIDED "AS IS" WITHOUT
  81. WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED
  82. TO, THE IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE.

  84. Limitation of Liability: In no event will PowerPro or its dealers be liable
  85. for any damages whatsoever, including, loss of data, lost profits, or other
  86. pecuniary loss arising out of the use or inability to use this product,
  87. even if PowerPro or an authorized dealer has been advised of the possibility
  88. of such damage.

  90. PowerPro does not warrant that the Program, or its functions, will meet
  91. your requirements or that the operation of the Program will be uninterrupted
  92. or error free. The entire risk as to the judgement of proper use, quality
  93. and performance of the program is with you.
